1. Acceptance of Terms

By accessing or using Sendly ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. Sendly reserves the right to update these terms at any time.

2. Description of Service

Sendly is a global payment platform that enables freelancers to receive payments from clients worldwide via a unique payment link. Users can receive payments via card, Apple Pay, or cryptocurrency, and withdraw funds to their local bank accounts or crypto wallets.

3. Eligibility

You must be at least 18 years old to use Sendly. By creating an account, you confirm that you are at least 18 years old and have the legal capacity to enter into these terms.

4. Account Registration

You agree to provide accurate and complete information when creating your account. You are responsible for maintaining the confidentiality of your password and account. You must notify us immediately of any unauthorized use of your account. Sendly is not liable for any loss resulting from unauthorized use of your account.

5. Fees and Charges

Sendly charges the following platform fees:

  • Professional Payment: 5% charged to the sender on top of the invoice amount. Full buyer and seller protection included.
  • Direct Payment: 2.5% charged to the sender on top, and 2.5% deducted from the receiver. Instant release with no disputes.
  • Tip / Donation (PRO only): 0% charged to the sender. 1% deducted from the receiver. Instant release.
  • Withdrawal fee: 1% on all withdrawals (0.5% for PRO users).

These fees are automatically deducted and are non-refundable. Sendly reserves the right to modify fees with prior notice to users.

6. KYC and Identity Verification

Sendly requires identity verification (KYC) to comply with financial regulations and prevent fraud. Users must provide accurate identity documents including BVN, NIN, and government-issued ID. Sendly reserves the right to suspend accounts that fail or refuse to complete KYC verification. We do not share your identity information with third parties except where required by law.

7. Prohibited Activities

You agree not to use Sendly for:

  • Money laundering or financing illegal activities
  • Fraud, scams, or deceptive practices
  • Payments for illegal goods or services
  • Any activity that violates applicable laws or international regulations
  • Creating multiple accounts to evade restrictions
  • Filing fraudulent chargebacks after receiving agreed services

Violation of these rules will result in immediate account suspension and reporting to relevant authorities.

8. Withdrawals and Fund Holds

All received payments via Professional Payment are subject to a 7-day holding period before they become available for withdrawal. Direct Payment and Tip/Donation payments are released instantly.

A 5% reserve is held from each Professional Payment transaction for 30 days as protection against chargebacks. This reserve is automatically released to your available balance after 30 days if no chargeback is filed.

In the event of a chargeback filed by a sender after funds have been released, Sendly reserves the right to recover the disputed amount from the freelancer's future earnings, pending withdrawals, or reserve balance on the platform.

Withdrawal requests are processed within 1-3 business days. Crypto withdrawals are irreversible — users are solely responsible for providing correct wallet addresses.

9. Disputes and Chargebacks

Senders who have a dispute with a payment are encouraged to first contact Sendly support at support@sendly.app before filing a chargeback with their bank. Sendly will investigate all disputes fairly and aim to resolve them within 5 business days.

Filing a fraudulent chargeback after receiving the agreed service is a violation of these terms and may result in the sender being permanently banned from the platform and reported to relevant authorities.

Freelancers who receive a chargeback dispute must cooperate with Sendly's investigation and provide evidence of service delivery when requested. Failure to cooperate may result in automatic refund to the sender.

Note: Disputes and chargebacks are only available for Professional Payment transactions. Direct Payment and Tip/Donation transactions are final and non-disputable as the sender explicitly chose these payment types.

10. Account Suspension, Freezing and Termination

Sendly reserves the right to suspend, freeze, or terminate any account at any time for violation of these terms, suspected fraudulent activity, chargeback disputes, scam reports, or at our sole discretion.

Frozen accounts: When an account is frozen all withdrawals are immediately suspended. The account balance is held pending investigation. The freeze reason will be communicated to the account holder.

Balance confiscation: In cases of confirmed fraud, scamming, or repeated violations, Sendly reserves the right to confiscate all or part of a frozen account's balance. Confiscated funds may be used to compensate affected senders or absorbed by the platform after a 90-day holding period.

Appeals: Frozen account holders may appeal their account status by contacting support@sendly.app within 30 days of the freeze. After 30 days with no appeal the freeze becomes permanent.

Dormant balances: Balances on permanently terminated accounts with no appeal after 90 days will be transferred to Sendly's operating account.

11. PRO Subscription

PRO subscriptions are billed monthly ($10/month) or annually ($50/year). PRO status is activated immediately upon successful payment. Sendly does not offer refunds on PRO subscriptions. You may cancel at any time and your PRO benefits will remain active until the end of your billing period.

12. Limitation of Liability

Sendly is not liable for any indirect, incidental, or consequential damages arising from your use of the platform. Our maximum liability to any user shall not exceed the total fees paid by that user in the 3 months preceding the claim. Sendly is not responsible for losses due to third-party payment processor failures.

13. Evidence and Transaction Records

All transactions on Sendly are recorded with full details including sender information, payment method, amount, timestamp, and transaction reference. These records may be used as evidence in chargeback disputes, fraud investigations, or legal proceedings. By using Sendly you consent to the use of your transaction data for these purposes.
